Occupancy certificate (OC) is the last and the most important document a developer is expected to obtain in the process of construction. This document certifies that developer has built the building as per the plan and has obtained all the other approvals that he is supposed to obtain in the due course of construction. This is like a degree that you get after successfully passing an examination. If the building does not have an occupancy certificate, you will find difficulty in financing such property, selling such a property. Also in case of an accident, you will find it difficult to get a remedy or to find a person responsible for that accident
If your building does not have an OC, you should file a case in consumer court against the builder and ask for specific performance. OC is given to the entire building structure and not to a particular flat. In the new regulations, the builders are expected to obtain OC within stipulated time line, failure to do this builder is liable to prosecution as well as penalties
